The <a href="https://www.pelham.ca/en/business-and-development/resources/Documents/Planning_OfficialPlan/Official-Plan.pdf" target="_blank" title="Open new window to view Official Plan"></a>Official Plan is a municipality&#39;s blueprint for the future.&nbsp;The Plan contains policies that guide municipal planning decisions and information on the future expansion of the Town&#39;s network of roads, water mains, and sewers. The schedules (maps) show where residential, commercial, industrial, institutional, and recreational development can go and what areas must be protected from development.In late 2022 the Region of Niagara Official Plan was approved by the Ministry of Municipal Affairs and Housing. The Town now has a responsibility to bring the current Town of Pelham Official Plan into conformity with the Niagara Regional Official Plan.Picturing Pelham - Official Plan Review will review and update the existing policies of the Plan in context with the new Regional Official Plan and new Provincial Planning Legislation.As part of that process, the Town has retained a consultant to conduct the conformity review of the existing Official Plan, which is to identify and provide recommendations on where the Official Plan needs to be updated to conform to:<ul><li>Provincial legislation, including recent changes made to the Planning Act and other legislation;</li><li>Provincial Policy Statement 2020;</li><li>Provincial Plans, including the Growth Plan for the Greater Golden Horseshoe (2020), Greenbelt Plan (2017) and Niagara Escarpment Plan (2017); and</li><li>The recently approved Region of Niagara Official Plan (2022)</li></ul>It is anticipated that the consultant will have the conformity review completed and a draft conformity report prepared by the end of April 2023. The conformity review will include a review of the Town of Pelham&#39;s community profile, assess various policy drivers, and identify policy conflicts, gaps, and opportunities.The conformity report will be shared with the community and with various agencies, i.e., Region of Niagara, Niagara Peninsula Conservation Authority, etc., for review, input, and comment.&nbsp; **Stay connected to the Official Plan project by following this page to ensure that your comments and input can be included. **

Town of Pelham Official Plan 

The Pelham Street Reconstruction project includes the reconstruction of Pelham Street from the Fonthill downtown core to the south Town limit, approximately 150 m south of Quaker Road. The project will be completed in four phases at an estimated cost of $9M. The Town has received a grant from the ICIP Rural and Northern Stream for $4.2M to complete the Pelham Street Reconstruction project. Phase 1:The project&#39;s first phase included the reconstruction of Pelham Street between College Street and Port Robinson Road. This project commenced in the fall of 2020 and was completed in the spring of 2021. <a href="https://www.pelham.ca/en/business-and-development/pelham-street-reconstruction.aspx">https://www.pelham.ca/en/business-and-development/pelham-street-reconstruction.aspx</a> Phase 2:The project&#39;s second phase involved the reconstruction of Pelham Street from Port Robinson Road to approximately 50 m south of Pancake and John Street. The project included a complete reconstruction of the roadway, including newly paved surfaces including designated on-road bicycle facilities, concrete curb and gutter, new concrete sidewalks, a new storm drainage system to improve drainage and mitigate flooding concerns, a new water main and new street lighting for both vehicular and pedestrian traffic. The project also included pedestrian safety and traffic calming measures at the key intersections, including a raised tabletop intersection at Port Robinson Road. Phase 2 of the project began in the spring of 2021, and all significant elements were completed by December 2021. Additional finishing work, such as sod, was completed in the spring of 2022. Phase 3:The Pelham Street reconstruction project included the reconstruction of Pelham Street between John Street and Spruceside Crescent South. It consisted of a new watermain and a new storm drainage system to improve drainage and mitigate flooding concerns.The work was part of the Pelham Street Reconstruction project. The project&#39;s limits for phase three were from south of John Street to south of Spruceside Crescent South. The Town received a grant from the ICIP Rural and Northern Stream for $4.2M for all phases of the Pelham Street reconstruction project. The project was substantially complete, including base asphalt, in December of 2022, and the restoration works, including landscaping and top asphalt, are being completed in the spring of 2023. This contract is carried out for the Town by Rankin Construction Inc. The contract administrator for the project, who will also carry out full-time construction inspection on behalf of the Town is Associated Engineering. Phase 4:The Pelham Street reconstruction project includes the reconstruction of Pelham Street between Spruceside Crescent South and the Town border, approximately 450m south of Quaker Road. It will consist of a new watermain and a new storm drainage system to improve drainage and mitigate flooding concerns.This work is part of the Pelham Street Reconstruction project that will be completed over the next two years. The project&#39;s limits for this phase will be from south of Spruceside Crescent South to approximately 450m south of Quaker Road.Construction is scheduled to begin in June 2023 and be completed by May 2024. It is anticipated that the project will be substantially complete, including base asphalt, by December of 2023, and the restoration works, including landscaping and top asphalt, will be completed in the spring of 2024.

Pelham Street Reconstruction

Draft Plan of Subdivision and Zoning By-law Amendment The Town of Pelham received an application for Draft Plan of Subdivision and Zoning By-law Amendment for the property located 1112 Haist Street known legally as Part of Lot 3, Concession 9 in the Town of Pelham, Regional Municipality of Niagara.The requested Zoning By-law Amendment would rezone the lands from Residential One (R1) to Residential Two (R2). The zoning change will allow the lots to have a minimum lot frontage of 12 metres and a minimum lot area of 360 m2.The proposed draft plan of subdivision would create four lots for single detached dwellings.

April 5 Update: The Town of Pelham&#39;s new Comprehensive Zoning By-Law, approved in August of 2022, has come into effect following an appeal process.On August 30, 2022, Council passed the new Comprehensive Zoning By-law, which resulted from a thorough public consultation process and extensive work by Town staff. In late September 2022, the By-law was appealed by a local property owner, and as a result, the Comprehensive Zoning By-law could not come into force while the appeal was pending. The Ontario Land Tribunal approved the order on Monday, April 3, 2023, with the result that the Comprehensive Zoning By-law is deemed to have come into force on August 30, 2022, except as it relates to the owner&#39;s lands that had appealed.The Comprehensive Zoning By-law regulates the use of land throughout the Town of Pelham in accordance with Section 34 of the Planning Act. The Comprehensive Zoning By-law has been updated to conform to the Town Official Plan, Region of Niagara Official Plan and Provincial legislation. The effect of the Comprehensive Zoning By-law will be improved development parameters that help create a more attractive, prosperous and livable community.&quot;With fundamental shifts in the focus of the provincial, regional, and local policy framework since the previous 1987 zoning by-law,&quot; said director of community planning and development Barbara Wiens. &quot;Pelham has worked with public consultation, staff and Council to align the Comprehensive Zoning By-law with the current planning policy framework at all levels of government.&quot;The Comprehensive Zoning By-law is a hybrid, using contextual zoning primarily in the Town&#39;s greenfield areas and conventional zoning in the more built-up areas and rural agricultural areas of Pelham. The new Zoning By-law reflects the Town&#39;s unique community structure, encompassing well-developed and complete urban communities, existing development areas, new greenfield opportunities, a village, a hamlet, and diverse rural and agricultural land use. ****March 2022The Zoning By-law, By‐law No. 1136 for the Town of Pelham, was originally approved in 1987. Zoning By-law No. 1136 is out of date and requires updating as a significant period of time has elapsed since it was originally prepared more than 30 years ago. It needs to be representative of current development trends and should be made to be more flexible to respond to future changes as well. Further, the Zoning By-law needs to be updated to conform with the Town Official Plan.There have been some fundamental shifts in the focus of the Provincial, Regional and local policy framework since the original 1987 zoning by-law.
