An application for Zoning By-law Amendment has been received for the lands legally described as Part of Thorold Township Lots 171-172; Part 1 on RP 59R-728 (see attached plan), known municipally as the Forest Park Plan of Subdivision in the Town of Pelham.
The requested Zoning By-law Amendment would amend the existing site-specific Residential 2-129 (R2-129) zone for single detached dwellings within a portion of the plan of subdivision. The following revisions to the existing zoning are requested:
- Revised definition of lot frontage: where the front lot line is not a straight line, or where the side lot lines are not parallel, the lot frontage is determined from the lot centre line to a point 7.5m back from the front lot line measured horizontally at 90 degrees from the lot;
- Minimum Front Yard: 4.0 metres to front face and 6.0 metres to garage (the garage of the dwelling shall be a minimum of 0.6 metres behind the front face of the dwelling or covered porch);
- Maximum Attached Garage Width: 50% of Lot Frontage;
- Maximum Driveway Width: 50% of Lot Frontage for the first 6 metres, 60% of lot frontage 6 metres behind the front property line;
- Maximum Height: 13 metres; and,
- Minimum Rear Yard: 4 metres (only applicable for Lot 34).
The purpose of the revisions is to allow for flexibility in building design related to driveway and garage widths for the single detached dwellings within the plan of subdivision, as well as to allow for flexibility in height for lots with basement walkouts.

TAKE NOTICE that the Council of the Corporation of the Town of Pelham passed By-Law No. 79-2024 on November 20, 2024, being a by-law which amends Zoning By-law No. 4481 (2022), as amended, under Section 34 of the Planning Act, R.S.O. 1990, as amended.
Procedure for Filing an Appeal: The Planning Act, R.S.O. 1990, Section 34(19), as amended states that an appeal may be filed by the applicant, the Minister of Municipal Affairs and Housing, a “specified person” and/or any “public body” (as defined by the Planning Act, Section 1(1)) within twenty (20) days of the making of the decision.
Appeals may be made by filing a notice of appeal with the Clerk via the Ontario Land Tribunal (OLT) e-file portal. Public users can access the portal at the following link: https://olt.gov.on.ca/e-file-service/ by selecting Pelham, (Town of), as the Approval Authority. If the e-file portal is down, please file the appeal with the Clerk’s Office in-person, or electronically using the following email address: clerks@pelham.ca All appeals must be submitted by the deadline indicated in the Notice of Decision.
The prescribed fee for filing a zoning by-law amendment appeal with the OLT is $400.00 for a private citizen, a registered charity or a non-profit ratepayers’ association and $1,100 for a corporation. Payment can be made online through e-file or a certified cheque/money order, including the Appeal ID number(s), can be submitted to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca.
Last day for filing an appeal of this decision to the Ontario Land Tribunal is Wednesday December 11th, 2024 by 4:30 p.m.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Pelham before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
